 YOUR USE OF THE WEBSITE CONSTITUTES YOUR AGREEMENT TO FOLLOW AND BE BOUND BY THE AGREEMENT. WE RESERVE THE RIGHT TO UPDATE OR MODIFY THIS AGREEMENT AT ANY TIME WITHOUT PRIOR NOTICE. FOR THIS REASON, WE ENCOURAGE YOU TO REVIEW THE AGREEMENT WHENEVER YOU USE THE WEBSITE. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT USE THE WEBSITE.

Transactions

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event we make a change to or cancel an order, we will attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

Right to Change

We reserve the right, at any time in our sole discretion, to modify, suspend or discontinue the website or any service, content, feature or product offered through the website, with or without notice; and/or offer opportunities to some or all users of the website.  You agree that we shall not be liable to you or to any third party for any modification, suspension or discontinuance of any service, content, feature or product offered through the website.

Errors

Occasionally there may be information on our website that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, and availability. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information or cancel orders if any information on the Website is inaccurate at any time without prior notice (including after you have submitted your order).

CINCH REWARDS PROGRAM TERMS AND CONDITIONS


Effective Date: January 1, 2019.

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY ACCESSING OR PARTICIPATING IN THE CINCH REWARDS PROGRAM, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS AND ALL TERMS INCORPORATED BY REFERENCE AS DESCRIBED BELOW.

These CINCH Rewards Program Terms and Conditions ("Rewards Terms") apply to your access to and participation in the CINCH Rewards Program ("Rewards Program" or "CINCH Rewards"), which is operated by Miller International, Inc. or its affiliates (collectively, "CINCH", "MII", "our", "us" or "we"). These Rewards Terms do not alter in any way the terms or conditions of any other agreement you may have with CINCH for other products and services. Please note that your access to and participation in the Rewards Program is also governed by the terms, conditions, limitations and requirements linked in these Rewards Terms, all of which (as may be changed over time) are incorporated into these Rewards Terms. In addition, these Rewards Terms complement and incorporate by reference the CINCH Terms of Use. In the event of any conflict between the CINCH Terms of Use and these Rewards Terms, the CINCH Terms of Use will control.
CINCH reserves the right to change, modify and/or eliminate the Rewards Program and/or all or any portion of these Rewards Terms or any policy pertaining to the Rewards Program at any time and in our sole discretion, including our right to discontinue or change the Tiers (defined below) or benefits or change the expiration date of Rewards Points (defined below) or Rewards Codes (defined below) received under the Rewards Program, merge the Rewards Program with another rewards program, or to adjust how Rewards Points are earned, calculated or redeemed. It is possible that you may be unable to receive enough Rewards Points to redeem a Rewards Code if we discontinue the Rewards Program or merge the Rewards Program into another rewards program. If we make changes, we will post the amended Rewards Terms to https://cinchjeans.com/store/pc/viewContent.asp?idpage=21&theme=cinch and update the "Effective Date above".  Unless we say otherwise, the amended Rewards Terms will be effective immediately and your continued participation in the Rewards Program after the amended terms are posted will confirm your acceptance of the changes. If you do not agree to the amended Rewards Terms, you must stop participating in the Rewards Program.

1. Rewards Program Eligibility
You must be a United States resident (including residents of U.S. Territories) who is at least 18 years of age to participate in the Rewards Program. The Rewards Program is intended for personal use only, and commercial use by commercial customers and others purchasing items for resale are not eligible to participate in the Rewards Program. Current CINCH employees and contractors, their immediate family members living in the same household, and Industry Friends Discounts are not eligible to participate in the Rewards Program. 

2. Privacy
Please review our Privacy Policy, which also governs your visit to the CINCHJEANS.com website, to understand our practices.

3. Rewards Program Description
The Rewards Program is a free customer loyalty program that allows participants to earn "Rewards Points" with qualifying purchases on CINCHJEANS.com. Participants in the Rewards Program may redeem accumulated Rewards Points for "Rewards Codes" that can be used toward purchasing items on CINCHJEANS.com and may also use the Rewards Points for other purposes as may be provided by CINCH from time to time. These Rewards Terms provide a general overview of the Rewards Program.

4. Joining the Rewards Program
There are no membership fees associated with the Rewards Program. 
Enroll online when you log in to your existing CINCH account (when available) or when you register for a new CINCH Account.

5. Redemption of Rewards Points
Redeeming rewards points is fully automated. You will accrue 10 points per dollar spent, then once your total of accrued rewards points reaches 2500 points you will receive via email a $10 coupon.
Rewards Points accumulated under the Rewards Program and Rewards Codes issued when Rewards Points are redeemed are promotional in nature and have no cash value. Rewards Codes are redeemable in merchandise only and cannot be applied to previous purchases. Your Rewards Points, Reward Codes and your Rewards Program Account are personal to you and may not be sold, transferred (by operation of law or otherwise) or assigned to or shared with, family, friends or others, or used by you for any commercial purpose. You are responsible for any federal, state or local taxes applicable to your participation in the Rewards Program.

6. EXPIRATION OF REWARDS POINTS AND REWARDS CODES
Points. Your points are automatically converted to a $10 coupon every 2500 points. As an example, if you order $500 of merchandise at once you will be rewarded a $20 coupons for your next purchase. 
REWARDS Codes. REWARDS Codes expire ONE HUNDRED AND EIGHTY (180) DAYS from the date THEY ARE SENT TO YOU.

7. Impact of Merchandise Returns on Your Rewards Points and Rewards Codes
If you return merchandise that you purchased with your Rewards Codes in accordance with the CINCHJEANS.com Return Policy, you will be refunded the amount you paid (excluding the value of the Rewards Codes and any other discounts) to the original method of payment. For example, if you placed an order totaling $100 for one item and used a $10 Rewards Code, we will refund $90 to your original method of payment. If you purchase multiple items using a single Rewards Code, then the value of your Rewards Code is applied proportionally to each item, and returns of any one item will result in a refund of the amount you paid for the item, excluding the value of the proportionally applied value of the Rewards Code. You will not receive a replacement Rewards Code for returned merchandise and CINCH will not credit the redeemed Rewards Points back to your Rewards Program Account.
If you void a purchase or return your purchase, CINCH will deduct the Rewards Points that you were awarded for that purchase from your Rewards Program Account. If you have already redeemed those Rewards Points, this could potentially result in a negative Rewards Point balance in your Rewards Program Account.

8. Miscellaneous
Without notice to you, CINCH reserves the right to suspend or terminate your Rewards Program Account and/or your participation in the Rewards Program (in whole or in part), if CINCH determines in its sole discretion that you have violated these Rewards Terms, you have more than one Rewards Program Account, or that the use of your Rewards Program Account or your participation in the Rewards Program is unauthorized, abusive, deceptive, fraudulent or otherwise unlawful. CINCH may, in its sole discretion, suspend, cancel or combine Rewards Program Accounts that appear to be duplicate. In the event that your participation in the Rewards Program is terminated, you will not be able to redeem any accumulated Rewards Points
Without notice to you, CINCH also reserves the right to "unregister" a Rewards Program Account that is inactive and cause that Rewards Program Account to be ineligible for the Rewards Program. An inactive Rewards Program Account is defined as a Rewards Program Account that has not earned Rewards Points for one year. In the event that your Rewards Program Account is unregistered due to inactivity, then you will no longer be eligible for Rewards Program benefits, including accumulating Rewards Points or converting your Rewards Points into Rewards Codes. You may reactivate your Rewards Program Account by logging into your CINCH Account or making a purchase using your CINCH Account that is associated with your Rewards Program Account, but any Rewards Points earned prior to the Rewards Program Account being deemed inactive will be voided.
